2. Our service and terms
2.1. Our services: Get Birding provides a paid for subscription service known as “The Flock”.
The Flock is available through two subscription options: “Wren” or “Starling”. These
subscription options allow members to access premium podcasts streamed via the
Internet to computers and mobile devices via an array software or apps, and premium
written content and articles.
2.1.1. Sign up to Wren for: Ad-free episodes and Exclusive bird-related content.
2.1.2. Sign up to Starling for All Wren benefits; Exclusive content featuring Sean
Bean, including extended interviews, Birding news from Dr Mya-Rose Craig,
Access to the members-only chatroom, Early access to episodes.
2.2. These Terms of Use govern the order by you and supply of services by us to you and
your use of the service. They apply to the exclusion of any other terms that you seek to
impose or incorporate, or which are implied by law, trade custom, practice or course of
dealing. Our premium podcast is provided to you in conjunction with our platform partner,
Supporting Cast, and use thereof by you is and remains subject to their acceptable use
policy found here: https://www.supportingcast.fm/aup
2.3. As used in these Terms of Use, “The Flock”, “our service” or “the service” means the
paid for subscription services provided by Get Birding to you in accordance with these
terms.
2.4. The Get Birding podcasts are directed to people residing in the United Kingdom. We do
not represent that content available on or through our platform is appropriate for use or
available in other locations.
2.5. These terms are made only in the English language.
3. How to become a member
3.1. To become a member simply choose one of the two paid subscription options “Wren” or
“Starling”, click on the link and follow the instructions.
3.2. To be a member you need to:
3.2.1. be 18 years old or over
3.2.2. have signed up to an account with us
3.2.3. use the services for your personal use only
3.2.4. Agree to these terms
3.3. To use The Flock service you must have Internet access and a podcast ready device,
and provide us with one or more Payment Method(s). “Payment Method” means a
current, valid, accepted method of payment, as may be updated from time to time, and
which may include payment through your account with a third party. Unless you cancel
your membership before your billing date, you authorize us to charge the membership
fee (see “Membership Fee” below) for the next billing cycle to your Payment Method (see
“Cancellation” below).
3.4. Our chosen third party payment service provider is Stripe Inc, through its UK subsidiary,
Stripe Payments (UK) Limited, a licenced electronic money institution in the UK which is
authorised by the Financial Conduct Authority to process payments. Stripe will process
all payments.
3.5. You can find specific details regarding your subscription membership, at any time, by
visiting our website https://getbird.ing/account and clicking on the “Dashboard” link
available at the top of the pages of the subscription website under your profile name.
3.6. Your subscription membership will continue until terminated in accordance with these Terms of Use.

4. Billing and Cancellation
4.1. The Membership Fee for each option are available here: https://getbird.ing/membership/
4.2. Billing Cycle. The Membership Fee for The Flock service will be charged to your
Payment Method on the specific billing date indicated on your “Account” page. The
length of your billing cycle will depend on the type of subscription that you choose when
you sign-up for the service. In some cases your payment date may change, for example
if your Payment Method has not successfully settled or if your paid membership began
on a day not contained in a given month. Visit our website and click on the “Account”
page to see your next payment date.
4.3. Payment Methods. To use The Flock service you must provide one or more Payment
Methods. You authorize us to charge any Payment Method associated with your account
in case your primary Payment Method is declined or no longer available to us for
payment of your subscription fee. You remain responsible for any uncollected amounts.
If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise,
and you do not cancel your account, we may suspend your access to the service until we
have successfully charged a valid Payment Method. For some Payment Methods, the
issuer may charge you certain fees, such as foreign transaction fees or other fees
relating to the processing of your Payment Method. Local tax charges may vary
depending on the Payment Method used. Check with your Payment Method service
provider for details.
4.4. Updating your Payment Methods. You can update your Payment Methods by going to
the “Account” page. We may also update your Payment Methods using information
provided by the payment service providers. Following any update, you authorize us to
continue to charge the applicable Payment Method(s).
4.5. Cancellation and your legal right to change your mind. You can cancel your The Flock
membership at any time, and your cancellation will be effective from the end of the
relevant billing period, at which point you will no longer have access to the subscription
service. Payments are non-refundable and we do not provide refunds or credits for any
partial membership periods or unconsumed The Flock content. To cancel, go to the
“Account” page and follow the instructions for cancellation. If you cancel your
membership, your account will automatically close at the end of your current billing
period. To see when your account will close, click “Billing details” on the “Account” page.
You also have a right to change your mind. As a consumer of online services, you have
14 days after the date we confirm your order to change your mind about a purchase, but:
you lose your right to cancel any service which it has been completed (and you must pay
for any services provided up to the time of cancellation.
4.6. Changes to the Price and Subscription Plans. We may change our subscription plans
and the price of our service from time to time; however, any price changes or changes to
your subscription plans will apply to subsequent billing cycles following notice of the
change(s) to you.

5. How you can use the Service
5.1. You must be 18 years of age to become a member of The Flock service. People under
the age of 18 may only use the service under the supervision of an adult.
5.2. The Flock service and any content consumed through the service are for your personal
and non-commercial use only and may not be shared with individuals beyond your
household.
5.3. During your The Flock membership we grant you a limited, non-exclusive, non-
transferable right to access The Flock and listen to The Flock content. Except for the
foregoing, no right, title or interest shall be transferred to you. You agree not to use the
service for public performances. We may terminate or restrict your use of our service if
you violate these Terms of Use.
5.4. You agree not to archive, reproduce, distribute, modify, display, perform, publish,
license, create derivative works from, offer for sale, or use (except as explicitly
authorized in these Terms of Use) content and information contained on or obtained
from or through The Flock service. You also agree not to: circumvent, remove, alter,
deactivate, degrade or thwart any of the content protections in The Flock service; use
any robot, spider, scraper or other automated means to access The Flock service;
decompile, reverse engineer or disassemble any software or other products or
processes accessible through The Flock service; insert any code or product or
manipulate the content of The Flock service in any way; or use any data mining, data
gathering or extraction method. In addition, you agree not to upload, post, e-mail or
otherwise send or transmit any material designed to interrupt, destroy or limit the
functionality of any computer software or hardware or telecommunications equipment
associated with The Flock service, including any software viruses or any other computer
code, files or programs. We may terminate or restrict your use of our service if you violate
these Terms of Use or are engaged in illegal or fraudulent use of the service.
5.5. The quality and download speed of the audio of The Flock content may vary from device
to device, and may be affected by a variety of factors, such as your location, the
bandwidth available through and/or speed of your Internet connection. If our supply of
your service is delayed by and event outside of our control, we will contact you as soon
as possible to let you know and do what we can to reduce the delay. However, we will not
provide compensation for the delay. You reserve the right to cancel the contract at any
time in accordance with these terms.
5.6. Passwords and Account Access. The member who created The Flock account and
whose Payment Method is charged (the “Account Owner”) has access and control over
The Flock account and The Flock ready devices that are used to access our service and
is responsible for any activity that occurs through The Flock account. To maintain control
over the account and to prevent anyone from accessing the account (which would
include information on viewing history for the account), the Account Owner should
maintain control over The Flock compatible devices or apps that are used to access the
service and not reveal the password or details of the Payment Method associated with
the account to anyone. You are responsible for updating and maintaining the accuracy of
the information you provide to us relating to your account. We can terminate your
account or place your account on hold in order to protect you, The Flock or our partners
from identity theft or other fraudulent activity.
5.7. Withdrawal of services and/or ending our contract with you. We can stop providing a
service. We will let you now at least 30 days in advance and we will refund any sums you
have paid in advance for services which will not be provided. We can end our contract
with you for a service and claim any compensation due to us if:
5.7.1. You do not make any payment to us when it is due and you still do not make
payment within 14 days of our reminding you that payment is due;
5.7.2. You do not within a reasonable time of us asking for it, provide us with
information, cooperation or access that we need to provide the service.
5.8. No Compensation. We are not responsible for losses you suffer caused by us breaking
this contract if the loss is:
5.8.1. Unexpected/unforeseeable, in that it was not obvious that it would happen and
nothing you said to us before we accepted your order meant we should have
expected it.
5.8.2. Caused by a delaying event outside of our control.
5.8.3. Avoidable in that something you could have avoided by taking reasonable
action, including following reasonable instructions for use.
5.9. Limitation of Liability.
5.9.1. Nothing in these Terms of Use limits any liability which cannot legally be limited,
including liability for:
5.9.1.1. death or personal injury caused by negligence; and
5.9.1.2. fraud or fraudulent misrepresentation; and
5.9.1.3. breach of the terms implied by section 2 of the Supply of Goods
and Services Act 1982 (title and quiet possession).
5.9.2. Subject to 5.9.1, we will not be liable to you, whether in contract, tort (including
negligence), for breach of statutory duty, or otherwise, arising under or in
connection with the Contract for:
5.9.2.1. loss of profits;
5.9.2.2. loss of sales or business;
5.9.2.3. loss of agreements or contracts;
5.9.2.4. any indirect or consequential loss.
5.10. Subject to 5.9.1, our total liability to you arising under or in connection with the Contract,
whether in contract, tort (including negligence), breach of statutory duty, or otherwise,
will be limited to 100% of the total Membership Fee paid by you under the Contract.
5.11. Unless you notify us that you intend to make a claim in respect of an event within the
notice period, we shall have no liability for that event. The notice period for an event shall
start on the day on which you became, or ought reasonably to have become, aware of
you having grounds to make a claim in respect of the event and shall expire three months
from that date. The notice must be in writing and must identify the event and the grounds
for the claim in reasonable detail.
5.7.2. You do not within a reasonable time of us asking for it, provide us with
information, cooperation or access that we need to provide the service.
5.8. No Compensation. We are not responsible for losses you suffer caused by us breaking

6. Miscellaneous
6.1. Personal Data. How we use any personal data you give us is set out in our Privacy

6.2. Intellectual Property: All intellectual property rights in or arising out of or in connection
with the services is and will be owned by Get Birding. All rights are reserved in this
respect. .
6.3. Dispute Resolution. There are several options for resolving disputes with us:
6.3.1. Our Customer Support team will do their best to resolve any problems you have
with us or our services
6.3.2. Alternative dispute resolution is an optional process where an independent
body considers the facts of a dispute and seeks to resolve it, without you having to
go to court. We can provide details of an ADR entity and website address should
you wish to pursue this process.
6.3.3. These terms are governed by English law and wherever you live you can bring
claims against us in the English courts.
6.4. Governing Law. These Terms of Use shall be governed by and construed in accordance
with the laws of England and Wales.
6.5. Customer Support. To find more information about our service and its features or if you
need assistance with your account, please visit the “help” link featured at the bottom of
every page. For matters unrelated to The Flock content, streaming or downloading,

think there is something wrong with your service. Survival. If any provision or provisions
of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity,
legality and enforceability of the remaining provisions shall remain in full force and effect.
6.6. Changes to Terms of Use. The Flock may, from time to time, change these Terms of
Use. We can always change a service: to reflect changes in relevant laws and regulatory
requirements; and, to make minor technical adjustments and improvements, for example
to address a security threat. These are changes that do not affect your use of the service.

payment authorizations, invoices, changes in password or Payment Method,
